Due to concerns that the Department of Children and Family's (DCF) fair hearing system was not working as it should, a fair hearing evaluator was authorized in the FY 2014 budget to evaluate how the system was working. Fair hearings allow families who dispute a DCF decision to receive an impartial hearing. However, wait times for the hearings and the subsequent decisions can be very long - much longer than intended.

When families disagree with a DCF decision, they can ask for a hearing to resolve the issue. The hearings are supposed to be timely and conducted by an impartial hearing officer. However, there are concerns on both the timeliness of the hearings and the overall fairness for families disagreeing with DCF.

The Fair Hearing Evaluator authorized through the FY 2014 budget will conduct a review of DCF's fair hearing system to see if the hearings are meeting the needs of the families and children involved with DCF. The evaluator will deliver quarterly reports to the legislature with a preliminary report due by March 2015. The evaluator will be hired by the Office of the Child Advocate and will review:

- the time in between the fair hearing request and the hearing

- length of time until a decision is made

- if the hearing officer is independent without bias

- overall fairness to make sure no disparity exists in access to resources, legal council, etc.
